These Terms of Service govern all projects and engagements between SyncCAD ("we", "us") and you ("Client"). By submitting a project, making a payment, or hiring us through any platform, you agree to these terms.
1. Acceptance
By engaging SyncCAD โ whether via Freelancer.com, Fiverr, Upwork, WhatsApp, email, or direct invoice โ you confirm that you have read and agree to these Terms. If you are engaging on behalf of a company, you confirm you have authority to bind that company.
2. Services
SyncCAD provides professional CAD-related services including but not limited to: 3D rendering and visualization, 3D modeling, technical drafting, product design, sheet metal design, BIM modeling, reverse engineering, and animation. Service availability is subject to team capacity.
3. Scope & Project Briefs
All work is performed based on the project brief agreed at the start. Any material change to scope, dimensions, style, or requirements after work has commenced may result in additional charges. We will always notify you before proceeding with out-of-scope work.
- Briefs must be provided in writing (email, platform message, or form submission)
- Reference files, dimensions, and material specifications should be included upfront
- Verbal instructions alone are not sufficient for project commencement
4. Payment Terms
- Platform projects: Payment is handled by the respective platform (Freelancer.com, Fiverr, Upwork) per their escrow/milestone rules
- Direct/invoice clients: 50% deposit required before commencement; balance due upon delivery
- Retainer clients: Monthly fee due on the 1st of each month; 7-day grace period applies
- Late payments beyond 14 days may result in work suspension
5. Revisions
Revision rounds included per project type:
- Rendering: 2 rounds of revisions (camera angle, lighting, materials)
- 3D Modeling: 2 rounds (geometry and fit adjustments)
- Technical Drafting: 1 round (dimension corrections only)
- Retainer clients: Unlimited revisions within allocated hours
A revision is defined as adjusting existing elements. New additions or complete redesigns are treated as new scope and may incur additional charges.
6. Intellectual Property
Upon receipt of full payment, all deliverables and intellectual property rights are transferred to the Client. Before full payment, SyncCAD retains all rights to the work product. We may use completed work in our portfolio unless you request otherwise in writing. Client-supplied files and data remain the Client's property at all times.
7. Delivery & Timeline
Estimated timelines are provided in good faith and may vary based on complexity, revision rounds, and team capacity. SyncCAD is not liable for delays caused by:
- Late or incomplete briefs from the Client
- Force majeure events
- Platform outages or technical issues outside our control
We will communicate proactively if any delay is expected.
8. Client Responsibilities
- Provide accurate and complete project information
- Respond to queries within 3 business days to avoid project delays
- Ensure all reference materials provided are legally owned or licensed
- Not use our deliverables for illegal, harmful, or unethical purposes
9. Limitation of Liability
SyncCAD's total liability for any claim arising from a project shall not exceed the amount paid for that specific project. We are not liable for indirect, consequential, or incidental damages including lost profits or data loss. Our services are provided as-is for creative and technical purposes; engineering sign-off and certifications require a licensed engineer in your jurisdiction.
10. Termination
Either party may terminate a project with 5 business days written notice. In the event of termination by the Client, payment is due for all work completed to date. In the event of termination by SyncCAD (e.g., due to non-payment or breach), work product remains with SyncCAD until outstanding amounts are settled.
11. Disputes
We aim to resolve all disputes amicably within 14 days of notification. For platform-based projects, the platform's dispute resolution applies. For direct engagements, disputes shall be governed by the laws of Indonesia, with both parties agreeing to good-faith mediation before any legal proceedings.
12. Changes to Terms
We reserve the right to update these Terms at any time. Changes are effective upon posting to this page. Continued engagement after changes constitutes acceptance.
